OFFICIAL CONTEST RULES
Promotion Dates: March 31, 2026 – April 2, 2026
Location: Total Products Expo, Las Vegas Convention Center
1. ELIGIBILITY & CONTESTANT SELECTION
By participating, the contestant certifies they meet the following criteria:
- One Attempt Only: No contestant may participate on more than one occasion during the entirety of the contest.
- No Substitutions: The individual selected must be the one to participate; they cannot choose another person to swing on their behalf.
- Professional/Amateur Status Exclusions: The following individuals are strictly ineligible:
- Current or former professional or semi-professional golfers or coaches (global).
- Current or former college or Olympic golfers or coaches (global).
- Current or former high school golfers or coaches who have played/coached within the past five (5) years.
- Affiliation Exclusion: Current or former employees, family members, agents, or assignees of the Client or the promotional agency are ineligible.
- Maximum Participants: Total contestants for the duration of the event shall not exceed 225.
- Maximum Number of Winners: Total of $10,000 prize winners shall not exceed 2.
2. ATTEMPT REQUIREMENTS & SIMULATOR SETTINGS
- Distance: The shot must be taken on the SkyTrak+ simulator from a distance of at least 165 yards to the flagstick, as indicated by the software.
- Equipment: Only a regulation golf ball and standard golf clubs are permitted.
- No Practice: Once a contestant is notified of their participation, they are strictly prohibited from any practice, warm-up, or qualifying shots until the actual prize attempt.
- Definition of a “Shot”: A “shot” is a single swing taken by a pre-registered contestant. No mulligans, practice swings, or substitute shots are permitted on the target hole.
- Simulator Integrity: Simulator settings may not be altered or adjusted to make the hole-in-one easier than normal play conditions. Only one predesignated cup may be used on the green.
3. MANDATORY VIDEO & WITNESS PROTOCOLS
To satisfy insurance requirements, the following will be in effect:
- Continuous Recording: The entire promotion activity—including contestant selection, notification, the shot attempt, and the simulator screen result—must be recorded continuously.
- Witnesses: Two appointed non-participating officials (18+) will supervise every attempt. They must have a clear view of the hitting area and the simulator screen to confirm the result in real time.
- Investigation Consent: Contestants and witnesses acknowledge that in the event of a claim, the insurer (IP Group) may require a reasonable investigation, which may include polygraphic examination of the winner and officials as a condition of prize payment.
4. ASSUMPTION OF RISK, LIABILITY WAIVER, AND RELEASE
PLEASE READ CAREFULLY:
- Assumption of Liability: Participation in this contest involves physical activity. The Player expressly assumes all liability for any injury to themselves or others, and for any damage to property (including but not limited to simulator equipment, surrounding facility, or personal belongings) resulting from their participation, swing, or use of the facility.
- Waiver of Claims: The Player hereby releases and holds harmless JM Brands, JM Tobacco, Total Product Expo, the venue, and the insurance underwriters from any and all claims, damages, or causes of action arising out of the contest.
- No Third-Party Rights: The insurance contract for this prize is between the Client and IP Group. This contest does not create any third-party beneficiary rights for the contestant. If the insurer denies a claim due to a violation of these rules, the Client is not obligated to pay the prize to the contestant.
5. GOVERNING LAW & DISPUTES
This contest is governed by the laws of the Commonwealth of Pennsylvania. Any disputes regarding the insurance reimbursement or contest rules shall be submitted to binding arbitration in Delaware County, PA, pursuant to the Pennsylvania Uniform Arbitration Act.
6. DATA CAPTURE & PRIVACY NOTICE (2026 COMPLIANCE)
Notice at Collection: By participating in this Promotion, the Contestant acknowledges that JM Brands will collect “Personal Information” (PI) and “Sensitive Personal Information” (SPI), including but not limited to:
- Identifiers: Name, email address, phone number, and physical address.
- Visual/Audio Data: Continuous video and audio recording of the contestant’s image and voice during the prize attempt.
- Contest Performance Data: Digital swing data and simulator results.
- Purpose of Collection: This data is collected for the following purposes:
- Promotion Administration: To verify eligibility and fulfill prize claims with the Insurer (IP Group).
- Insurance Compliance: Video data is mandatory per the Insurer’s rules and may be used in investigations, including third-party audits.
- Marketing: (Optional/If applicable) If the Contestant opts in, the Client may use email/phone data for future promotional communications.
- Data Retention: In accordance with California law, video recordings of the Promotion will be retained for no longer than 90 days unless a claim is filed, in which case the data will be retained until the claim is fully adjudicated. All other Personal Information will be retained only as long as necessary to fulfill the purposes outlined above.
7. VIDEO SURVEILLANCE & CONSENT
- All-Party Consent Disclosure: The Promotion area is under active video and audio surveillance. Pursuant to California Penal Code §632, by entering the designated hitting area, all contestants and spectators provide their express consent to be recorded.
- Publicity Release: Contestant grants the Client a non-exclusive, perpetual license to use the footage of the “winning shot” for social media and marketing purposes without further compensation, unless prohibited by law.
- Right to Delete: Contestants have the right to request deletion of their personal data under the CCPA/CPRA, subject to the Client’s need to retain data for legal and insurance “Proof of Claim” purposes.
8. MARKETING CONSENT & OPT-OUT
- JM Brands Email Subscription: By providing their email address and signing the Participation Agreement, the Contestant provides express affirmative consent to be enrolled in the JM Brands Email list. Contestants will receive recurring marketing emails, newsletters, and promotional offers directly from JM Brands.
- Purpose of Data Use: JM Brands uses the captured email and participant data to personalize marketing content and track promotion analytics.
- Frictionless Opt-Out: In accordance with the 2026 California Delete Act, JM Brands provides a “one-click” unsubscribe mechanism in the footer of every email. Contestants may also exercise their “Right to Delete” or “Right to Opt-Out” at any time by visiting the JM Brands privacy portal at www.jmtobacco.com.
- Consent Not Mandatory for Entry: (Note: To avoid “forced consent” legal traps, ensure your staff knows that a player can technically enter the contest for the insurance prize without being forced to receive marketing, though you can make the marketing sign-up a default part of the registration form with a clear ‘Unsubscribe’ later).
- No Sale of Data: JM Brands certifies that it does not sell, rent, or share contestant personal information with third-party data brokers for monetary or other valuable consideration.
